Terms & Conditions and Right of Withdrawal

§ 1 Scope

These Terms and Conditions (T&Cs) apply to all purchase contracts concluded via the website esteriicreates.com between Ester Batllori I Vila (hereinafter "Seller") and buyers (hereinafter "Customers").

The version of the T&Cs in force at the time of the order shall apply.

§ 2 Formation of contract

The display of artworks on this website does not constitute a legally binding offer, but an invitation to order. By submitting an order, the Customer makes a binding offer to purchase.

The purchase contract is concluded only when the Seller explicitly accepts the order by email or at the latest upon dispatch of the goods.

If a product ordered is not available for reasons beyond the Seller's control, the Seller reserves the right not to accept the order. The Customer will be informed immediately and any payments made will be refunded.

§ 3 Prices and payment

All prices stated are total prices in euros (€) and include applicable VAT (MwSt.). Shipping costs are included in the price.

The following payment methods are available:

• Credit card / debit card (via Stripe)
• PayPal
• Klarna (instalment / invoice)

Payment is due upon conclusion of the contract. The payment method determines the exact time of payment processing.

§ 3a Product description – Framing

Unless expressly stated otherwise, all paintings are sold unframed. Frames visible in product photographs are for illustrative purposes only and are not included in the delivery.

§ 4 Delivery and shipping

Delivery is available worldwide. Shipping costs are included in the price of the artwork.

Delivery times are typically between 4 and 20 business days depending on the destination and size of the artwork. The specific delivery time will be communicated after the order. In the event of delays, I will notify you by email.

All works are carefully and securely packaged to prevent damage in transit. Original artworks are shipped as individual pieces.

For deliveries outside the EU, additional customs duties or import taxes may apply, which are the responsibility of the recipient.

§ 5a Damage in transit

All works are carefully packaged and shipped with insurance. If a delivery arrives visibly damaged, please:

• Note the damage with the carrier and do not sign without reservation.
• Document the damage with photographs (both packaging and artwork).
• Contact us by email within 48 hours of receipt: ester.batllori@gmail.com

In the event of confirmed transit damage, the Seller will offer an appropriate remedy. Claims made later without supporting documentation cannot be considered.

§ 5 Retention of title and transfer of risk

The purchased artwork remains the property of the Seller until payment has been received in full.

The risk of accidental loss or damage passes to the customer upon delivery of the goods to the customer or to the carrier.

§ 6 Statutory warranty

The statutory warranty rights apply. In the event of a defect, Customers are entitled to remediation, a price reduction or withdrawal from the contract. Natural material characteristics (e.g. colour variations, brushwork texture) are typical of handmade artworks and do not constitute a defect, provided they do not deviate from the agreed quality. Slight variations in colour may occur due to differences in screen displays and lighting conditions and do not constitute a defect.

§ 7 Copyright

By purchasing an artwork, the Customer acquires ownership of the physical work but not the copyright or any rights to use the work for commercial purposes. Copyright remains with the artist. Reproduction, duplication or commercial use of the depicted works requires express written consent.

§ 8 Applicable law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Berlin, insofar as the Customer is a merchant or does not have a general place of jurisdiction within Germany.

Right of Withdrawal Notice

Right of Withdrawal

Customers have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day on which the customer, or a third party designated by the customer, has received the goods.

To exercise the right of withdrawal, the customer must inform the seller (Ester Batllori I Vila, email: ester.batllori@gmail.com) of their decision to withdraw from the contract by means of a clear statement (e.g. email).

Effects of withdrawal

If the customer withdraws from this contract, all payments received will be refunded, including standard delivery costs, without undue delay and at the latest within 14 days from the day on which the seller is informed about the withdrawal.

The seller may withhold the refund until the goods have been returned or until the customer has provided proof of return.

The customer must return the goods within 14 days from notifying the withdrawal.

The customer bears the cost of returning the goods.

The customer is only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Exclusion of the right of withdrawal

The right of withdrawal does not apply to goods that are individually created or clearly tailored to the personal needs of the customer.
